Please read these terms carefully before using Amplify Streaming services.
These Terms of Service govern the provision of audio streaming services by Amplify Streaming, a service operated by Cloud365 Australia Pty Limited ABN available on request ("Amplify Streaming", "Cloud365", "we", "us"). By signing up for or using Amplify Streaming services, you agree to these terms in full.
Amplify Streaming provides professional audio streaming infrastructure including Icecast and Shoutcast stream hosting, HLS delivery, audio processing (Orban Optimod, Telos Omnia), stream monitoring, AutoDJ via the Amplify Control Panel, DDoS protection, and related broadcast engineering services as agreed at the time of sign-up.
The scope, pricing and configuration of your services are defined in the order or proposal accepted by you. Amplify Streaming reserves the right to update or modify services with reasonable notice, except where changes are required immediately to maintain security or compliance.
You are responsible for maintaining the security and confidentiality of your account credentials. You must notify us immediately if you become aware of any unauthorised access to your account. Amplify Streaming will not be liable for any loss or damage arising from your failure to secure your account.
You must provide accurate and current information when registering for services. If your contact or billing information changes, you are responsible for updating it promptly via the Client Portal.
Services are billed monthly in Australian dollars at the agreed price. Invoices are issued at the start of each billing period and are due within 14 days of issue.
We accept VISA, Mastercard and other payment methods available through the Client Portal. Failure to pay by the due date may result in service suspension after reasonable notice. Services that remain unpaid beyond 30 days of the due date may be terminated and associated data may be deleted.
All prices are exclusive of GST unless otherwise stated. GST will be applied where required by Australian law.
Amplify Streaming targets 99.9% uptime across streaming infrastructure. All services are hosted in carrier-grade datacentres operated by Cloud365 across Australia, Japan, Singapore, the United Kingdom and the United States.
Where a service interruption is caused by a fault within Amplify Streaming's infrastructure or control, we will provide credit or refund in accordance with any applicable SLA in your service agreement. We are not liable for outages caused by factors outside our reasonable control, including internet backbone failures, third-party encoder issues, or force majeure events.
Planned maintenance will be communicated with reasonable advance notice wherever practicable.
You agree to use Amplify Streaming services in accordance with our Acceptable Use Policy, which forms part of these Terms. Key obligations include using services only for lawful purposes, not engaging in activities that interfere with other customers or our infrastructure, and not broadcasting content that is illegal under Australian law.
Amplify Streaming may suspend or terminate services immediately if we determine that your use violates the Acceptable Use Policy or poses a risk to other customers, our infrastructure or third parties.
You retain ownership of all audio content, files, playlists and data uploaded to or generated on Amplify Streaming infrastructure. By using our services, you grant Amplify Streaming a limited licence to store and transmit your content solely for the purpose of delivering your services.
You are solely responsible for ensuring that all content you broadcast or upload complies with applicable copyright, licensing and broadcasting laws. Amplify Streaming does not monitor broadcast content and is not liable for any intellectual property infringement arising from your use of the service.
Upon termination of services, we will retain your data for up to 30 days before permanent deletion, unless you request earlier deletion or data export.
Orban Optimod and Telos Omnia audio processors are available as monthly rental add-ons. The equipment remains the property of Amplify Streaming or its suppliers at all times. Rental includes insertion into your stream and ongoing maintenance. Availability may be limited in some datacentre regions — please confirm availability before ordering.
All software, interfaces, branding, documentation and infrastructure provided by Amplify Streaming remain the intellectual property of Amplify Streaming or its licensors. You may not copy, reverse engineer, resell or redistribute any Amplify Streaming proprietary systems or materials without prior written consent.
Amplify Streaming will act promptly on receipt of valid intellectual property infringement notices. Repeat infringers will have their accounts terminated.
The collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using Amplify Streaming services, you consent to the practices described in the Privacy Policy.
Either party may terminate services with 30 days written notice. You may provide notice via the Client Portal or by contacting our Support Helpdesk.
Amplify Streaming may suspend or terminate services immediately and without prior notice in cases of: material breach of these Terms or the Acceptable Use Policy; non-payment beyond 30 days of the due date; or where continued provision of services would constitute a legal or security risk.
Upon termination, access to the Amplify Control Panel and all associated services will cease. Any outstanding amounts remain due and payable.
To the maximum extent permitted by Australian law, Amplify Streaming's total liability arising from or related to these Terms or the provision of services is limited to the monthly service charge for the affected service in the month in which the issue occurred.
Amplify Streaming is not liable for indirect, consequential, special or incidental damages including loss of revenue, loss of audience, loss of broadcast signal or reputational damage, even if advised of the possibility of such damages.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
Amplify Streaming reserves the right to update these Terms of Service from time to time. We will notify you of material changes by email or via the Client Portal with at least 14 days notice. Continued use of services after the effective date of updated terms constitutes acceptance of the revised terms.
These Terms are governed by the laws of Victoria, Australia. Any disputes arising under or in connection with these Terms are subject to the exclusive jurisdiction of the courts of Victoria, Australia.
